Sharad Desai – Nominee to the U.S. District Court for the District of Arizona

The brother of Ninth Circuit Judge Roopali Desai, Phoenix based attorney Sharad Desai is vying to become the first Indian American judge on the federal district court bench in Arizona.

Background

Born to an Indian immigrant family in Phoenix, Desai received a joint B.S. and B.A. from the University of Arizona in 2003 and then a J.D. from New York University School of Law in 2006. Desai then returned to Arizona to clerk for Arizona Supreme Court Justice Rebecca White Berch.

After his clerkship, Desai joined Osborn Maledon, P.A. in Phoenix. He became a Member with the firm in 2012. In 2015, he shifted to Honeywell International Inc., a business conglomerate working in aerospace and technology, among other areas, where he serves as Vice President and General Counsel.

History of the Seat

Desai has been nominated to the U.S. District Court for the District of Arizona, to a seat to be vacated on October 21, 2024, when Judge G. Murray Snow takes senior status.

Legal Experience

After his clerkship, Desai worked in litigation at Osborn Maledon, P.A. While at the firm, Desai represented a class of retired Arizona judges in a class action suit against a change in the calculations of pension benefit increases for judges. See Fields v. Elected Officials’ Retirement Plan, 320 P.3d 1160 (Ariz. 2014). Desai secured a victory for the class in trial court, which was affirmed by the Arizona Supreme Court. See id.

While at the firm, Desai was appointed by the Arizona District Court to represent a class of pretrial detainees in litigation by the Maricopa County Sheriff’s Office seeking to terminate consent agreements overseeing conditions in their jails. See Graves v. Arpaio, 48 F. Supp. 3d 1318 (D. Ariz. 2014). Desai maintained his representation of the class until he left the firm in 2015.

On the pro bono side, Desai represented a Nevada prisoner seeking recovery for costs from litigation challenging a disciplinary hearing against him. As part of his representation, Desai briefed and argued the appeal before the Ninth Circuit. See Jones v. McDaniel, 607 F. App’x 710 (9th Cir. 2015).

For the last nine years at Honeywell International Inc., Desai has served as a Counsel, advising various divisions of the company, and overseeing litigation in general. However, he has not appeared in court during this time. Nonetheless, Desai has supervised litigation, including in a $38 million product liability suit involving a Honeywell autopilot on an aircraft, which ended in a jury verdict in Honeywell’s favor after a two week trial. See Egbers v. Honeywell, Int’l, Cook County Circuit Ct. Case No. 06 L 6992 (Ill. 2016).

Overall Assessment

Perhaps more than any other Senator, Senator Kirsten Synema has been able to grease the wheels for nominees from her state. The three nominees to Arizona courts from the Biden Administration have each drawn more than 60 senators in support, a remarkable feat, given that only around 20% of the Administration’s judicial nominees have drawn that level of support.

While Desai is unlikely to get the same level of support, given the fact that his nomination will almost certainly be considered in the lame duck session, it is possible that Sinema will be able to work her magic a fourth time and ensure that Desai joins the bench in due course.

      Oh it’s totally fair to blame Schumer for this. Because all four of these nominees should have already gotten a vote. There was a window where two Republican senators were out for weeks at a time (One because they had eye surgery & the other because he was running for Vice President). I kept writing on this very blog then to tee up Mangi & Campbell then. Had they worked a full day on Monday, Thursday & Friday for even one week, both could have gotten confirmed with that window.

      I know Ryan Park hadn’t been voted to the floor yet but had they taken care of Mangi & Campbell then, they could have gotten Park confirmed earlier this week before DeSantis & other Republicans started to pressure senators to show up for work.

      This is complete incompetence plain & simple. I know some third graders that can count better than the majority leader of the US Senate. This is a direct result of their insistence on working Monday 3pm to Thursdays 3pm & not being able to do basic math.

        The schedule very much can change. If voters demand it the next time Democrats ask for our votes, it damn sure can change. But if Democrats like being in the minority then that’s fine, it doesn’t have to change.

        But make no mistake about it, the senators work for US. So it CAN change. Now will it is a totally different story but not because it can’t. More so because the American voter has shown to have a short memory.

    I just dont get it. this is criminal. this is unforgivable. This is a disgrace! I am angry! How can leaving four circuit court searts allowing trump to fill with right wing hacks be ok? to any sane democrat? i dont understand it. If there arent any votes let them fail on the floor, lipez and karla campell are great nominees and dont deserve this this is an outrage! call everyones offices now!

    I agree with Campbell but with Mangi, it’s bigger malpractice because as with Micheal Delaney, it was clear there were enough no votes on the Democratic side to sink his nomination.
    I get not wanting to cave into the anti-Muslim bigotry around him but there were other issues with him that were deal breakers and Biden/Schumer should have accepted defeat and nominated someone else.
    They didn’t and Republicans will get a seat gifted to them because of that.

    I am begging everyone, please please please take action. Call your senator’s office (both home state and DC offices) to express your profound disappointment. Also, call Schumer’s office, even if you’re not a NYer:

    MORE IMPORTANTLY: please call, email, write, tweet the major liberal advocacy groups, especially the justice oriented ones. 1 or 2 constituents calling their senators may not be seen like a big deal, but if we can get the big groups to apply pressure, maybe we can try to reverse course.

    I cannot say this will work, but my goodness we have to try something. If this is such a good deal, make Schumer come out and defend it… provide even more fodder for a potential primary challenger.

    Schumer is doing the opposite of Harry Reid. Reid ended his time as Senate Majority Leader by confirming even more Obama judges than was expected. Schumer’s last act is to give away seats in exchange for an earlier night.

    I have not been this worked up about judges since Hochul messed the bed with Hector Lasalle.

    Do something about this!

      Advocacy groups need to apply full court pressure over the holiday. Openly say they will not support any senate Democrat in the primary who does not publicly come out against this deal & call for a cloture & up & down vote for all four circuit court nominees. This is beyond outrageous that it’s hard to put into words.

    Took a few hours to get over the news.

    There is no silver lining/positive spin on any of this, but Wynn and Stranch are definitely going to revoke their senior status if no one is confirmed by January 20, 2025. They are some of the most liberal judges on their circuit. They are in their early 70’s, holding out for (hopefully) 4 more years should not be tough.

    I am confused about Lipez’s nomination, why would the White House move forward if Collins was never on board?

    I overslept a bit today and then was busy, and I get excited when I see that the number of comments on the Vetting Room is a lot higher than it was last time I looked. But then I look at the comments and I see this? I thought that Manchin and Sinema were actually becoming more cooperative now that they don’t have to face voters again (i.e. if one of them opposes a nominee the other will support, Manchin being absent last night to allow the cloture of nominees he probably opposes), but THIS is the price for that?

    I hope Wynn and Stranch rescind, while nothing can really be done about the other 3 seats. I also hope that Murillo is somehow confirmed (home county bias) but I don’t have faith that she will.

    Time to take another “victory” lap. Ever since Tillis started to say that he lined up 2 Dems votes against Park, assuring the defeat of the nominee, I’ve been saying that that’s not an empty bluff. Most of the wishful thinkers on here were ready to claim Tillis was lying or exaggerating and that I was naive for buying it.

    The fact is, that’s such an extraordinary claim for someone to make that it just didn’t sound like a mere bluff. Tillis never wavered from his threat. And now we see that Tillis was good on his threat, to the shame of everyone involved. Stop outright dismissing threats your opponents make merely because you don’t like to hear what they are saying.

    Ryan Park is now the Dems’ version of Estrada. A serious would-be SCOTUS contender that probably won’t ever be.

    I don’t know how anyone can say that this is a sort of a deal that Harry Reid would make when Reid went nuclear to confirm Obama’s lower court judges. What rule has Schumer changed to advance anything?

    Gavi, we knew who the two no votes on park were from team blue, as Dequan said the failure was not to move his nomination while other Republicans were out.
    Mangi is the one that angers me the most still, it was clear Democrats beyond Manchin/Sinema weren’t going to vote for him and yet they clung to his nomination.
    I get it, some of the attacks on him sucked but if the votes weren’t there, they weren’t there and it’s absurd that we gifted the Republicans a seat we could and should have filled.

    My blood has been boiling today. I’ve already called Ossoff’s office, Schumer’s office, as well as the Senate Judiciary Democrats office (202-224–7703).

    This is my first time ever calling a Senato’s office (instead of just writing) so that’s saying something.

    Even if Stranch and Wynn rescind, I already know who orange man will likely pick for the 1st and 3rd. I will spare posting their names for now because of how infuriating it is to even think about.

    So it looks like this deal really is as bad as first reported – here’s hoping that both Stranch and Wynn rescind ASAP, before the Republicans try to pull some shenanigans to prevent them from rescinding. Park and Campbell are both young enough to be nominated again in 4 years (if we’re lucky) or even 8 years, and I can’t imagine that Stranch will be happy with to let the spineless Dems screw over her former law clerk like this.

    There’s been some commentary on Bluesky about how the Dems just didn’t have the votes if Manchin/Sinema were insistent on voting no – but it’s hard to believe that they couldn’t have gotten Manchin/Sinema to just…stop showing up the rest of the year? Give them both a vacation to the Bahamas or something so that every vote at would be a 49-49 tie, which Harris could then have broken.

    What a disaster.

    Tillis is telling the two judges to NOT rescind, I hope they do it in spite.

    We can all assume blue slips will be ignored for the 3rd/1st Circuit seats, but I’m sure Collins will greenlight any Federalist Society hack Trump nominates to that seat, and King doesn’t feel like someone who would push back. At least the 3rd Circuit seat will be a good test for Andy Kim on judges?

    The same-party replacements on the Democratic sides should all be upgrades (going from Cardin to Alsobrooks in MD, Menendez to Kim in NJ, Carper to LBR in DE, and especially Sinema to Gallego in AZ, only iffy one IMO is Stabenow to Slotkin in MI).

    From what I’m seeing online and what I heard, Bob Casey did a Bill Nelson and didn’t take his race seriously until it was too late.

Let’s try to separate our wish. I would absolutely love for them to rescind, but Obama-era Dems are just too darn nice for their own good, thinking their niceness might save the republic.

    Soooo many conventional wisdoms have been smashed this month already, and there’s still more days to go. Why do I feel like institutional libs rescinding on retirement might not be one of those things?

    CNN now reporting the deal with an added statement from Durbin at the end. My God Democrats need new leadership. As much as I can’t stand the Republican Party, I must say they know how to purge weak leaders out of their ranks. And they have plenty of young senators who could potentially take over the Party post-Trump. I hope Democrats take the next 4 years to do the same. This leadership team throws in the white towel when they are in the lead & have the ball in their possession. It is time for a change.

    If schumer had half a spine he would have pulled the Desai confirmation today as punishment for Sinema working with Republicans to make this happen.

    I’m disgusted but not shocked, I’ve said all along that Schumber is a pathetic shadow of Mitch McConnell, in strategy, competence and perseverance.

    In every way this continues to be the worst timeline, the election showed Chuck nobody cares about the institutions, nobody cares about playing nice and nobody cares if you have to work 1 extra weekend.

    I get they couldn’t confirm Mangi but were too big a coward to blame their dem senators who gave in to Islamophobia to replace him but at least 2 should’ve gotten confirmed without issue.

    Thanks for making sure the election of Donald Trump and his cabinet of clowns isn’t the finale gut punch of this lousy year.

    I am absolutely bothered by the 1st circuit vacancy now going to Trump, I don’t care if that person will be the only on on the court. A lot can happen in 4 years. I am sorry, but it’s shortsighted to think that 1 vacancy on a powerful court is nothing.

    1: Trump didn’t inherit all 10 CA9 vacancies on his first day in the WH. They eventually opened up. Sure, the judges on the 1st are relatively young/new, but their are unknowns and unplanned events that you just cannot account for. Also, who knew that Trump would end his first term with 3 SCOTUS appointments?

    2: Trump/conservative judges tend to be powerful, even in dissent. One could say especially in dissent. Why? Because they don’t just tend to dissent, they screech their dissent to get the attention of the rightwing legal-sphere, and more importantly, SCOTUS. Take Patrick Bumatay, for example. His dissents are almost always picked up by Thomas. Even if SCOTUS doesn’t grant cert to hear a case in which Bumatay dissented, Thomas tends to publish opinions criticizing the court for not taking up such cases.

    3: And this one is very important: Lipez seemed on track to be the most confirmable of the group. How can you give up on an eminently confirmable nominee??? It’s very small comfort, but thank goodness Judge Kermit Lipez didn’t fully retire before his daughter got confirmed.

    4: My god, what was the worst that could happen for simply holding a vote???

      I agree, there will be no bargaining. Angus King, John Fetterman, and the NJ and DE senators will certainly get no input for the appellate vacancies in their states.

      Blue Slips will probably only survive until all the red state seats are full and Trump starts to get mad that more nominations aren’t moving.

    I just got home from work and am catching up with the news.

    There was a previous posting on the remaining judicial nominees. Republicans will support nine of the least controversial nominees and Democrats will drop the nine most controversial nominees. It reminds me of the Gang of 14 deal back in the day.

    It’s not a total loss for progressives. By all objective standards, the Democrats have been successful in confirming Federal judges during the Biden Administration. They came close to matching Trump’s record.

    I’ve been pretty demoralized since the election. I would’ve been fine (or whatever is worse than fine but still unhappy) with Trump winning as long as he had to deal with the same senate headaches that Biden had to deal with in 2021. A majority in the senate, but a lot of sweating to get nominees and judges through. Hell, if just one of the Brown/Tester/Casey triumvirate had won and the GOP had a 51-49 majority, it still gave me hopes that the worst of the worst of Trump’s cabinet and judicial nominees wouldn’t be rubber stamped. But all 3 losing makes Collin’s (fake) concern and Murkowski’s moderate schtick useless. There are 51 senators ready to confirm a cheese sandwich (that obviously clerked for Scalia and Thomas and leads their local FedSoc chapter) to whatever Trump and Thune wants.

    But the final nail in the coffin is to get on here and to check Twitter and see that Schumer rolled over like the walking roadkill he is and is allowing Trump to inherit THREE F*CKING APPELLATE VACANCIES in exchange for the remainder of the DISTRICT COURT NOMINEES. I feel like I’m crazy town, this must be backwards day, or this is a cruel prank to add insult to injury after getting everyone’s hopes up on election day. In the year of our lord 2024, a SENATE DEMOCRATIC LEADER just gifted A REPUBLICAN PRESIDENT 4 GODDAMN APPELLATE VACANCIES in exchange for more than a dozen TRIAL COURT/DISTRICT COURT JUDICIAL NOMINEES??!!?!?!

    Why would I go to the polls in 2026 and beyond to support a feckless party that rolls over and is scared of a confrontation??!?

      This is truly the most demoralized I’ve been politically in my lifetime. I remember my first time voting. I walked into the Miami-Dade polling location to happily cast my vote for Al Gore, the man I saw the night before on South Beach because I got invited by college activist on campus at Florida International University to an Al Gore rally featuring Stevie Wonder, Debra Cox & others. I’ll admit I didn’t know much about either of the candidates but hey, I was a college student & that free ticket was enough to get my vote 24 hours later. I remember asking the elderly polling assistant if it was ok my Chad’s weren’t punched all the way through & her assuring me it was fine, she can tell who I meant to vote for. I was so disappointed that my vote ultimately didn’t count because of the US Supreme Court’s decision in Bush v Gore. It made me want to learn more about who were these 9 people got to determine my vote didn’t count. That sparked my interest in the judiciary.

      As disappointed as I was in 2000, I was even more disappointed when John Kerry lost in 2004 & GW Bush was reelected. My faith in Democrats was revived in 2008 when Barak Obama won the presidency, Democrats won the House & eventually won a 60 vote, filibuster proof majority. I was at the height of my love for Democrats when majority leader Harry Reid invoked the Nuclear Option, finally ending the filibuster for judicial nominees.

      It’s been downhill since then. Trump winning in 2016 was the start. Durbin not ending blue slips once Democrats won back the presidency & senate was next. Some judicial issues such as the Ramirez/Childs/Pan nominations, Jabarri Wamble & William Delaney nomination debacles all were low points amongst some very bright highlights during the Biden presidency.

      But nothing… Nothing, nothing NOTHING could have prepared me for today. This is the single worst deal in judicial history. I know we have said majority leader’s McConnell or Reid wouldn’t have agreed to this. I honestly don’t think ANY majority leader in my lifetime would have agreed to such a horrible deal. Not Tom Dashcle, not Bill Frist, not Trent Lott. If you paid me one million dollars last night to come up with the worst possible deal that Chuck Schumer would agree to, it wouldn’t have been as bad as this deal.

      This is why Democrats lose. To put it bluntly, this is why Democrats deserve to lose. They have great ideas but can’t sell it while Republicans have terrible ideas but at least are tough & can get things done. I’ve said numerous times the Republicans are about to show Democrats what to do when you have power, but they are getting started while they are still in the minority. The Republican majority doesn’t start January 3rd. It started last night when this deal was agreed to. Congratulations to senate Republicans. They earned & deserve to be in the majority.

      Where is President Biden, still in the Amazon? Where is the vice President, off in Hawaii? Nobody was around to pump the brakes on this idiotic deal? This Democrat leadership team just needs to go. Just go. Seriously just go. The Party needs to hit rock bottom (Arguably that time has arrived already) & rebuild with young, fresh leadership. I would rather suffer the next four years through a President Trump & Republican majority in the senate then to EVER see Chuck Schumer or Dick Durbin leading senate Democrats again.

I wrote my own reflection below, but I forgot to mention under my 3rd Point, how I’m not convinced Democrats even care, that Harris decided NOW is the best time for a vacation. It’s time to confirm judges, and the Vice President is in Hawaii for a self-care trip? Give me a break. Democrats are making their priorities very clear (if they haven’t already).

    I’m learning about the deal where Schumer surrendered 4 circuit court seats for the remaining district court judges. Here’s what I take away.

    1. The rationale that “We didn’t have the votes to confirm these four appellate judges, anyway” is bullshit. Why would Thune agree to stop slowing down the process if he thought there was no chance of the judges being confirmed? He agreed because there was leverage; namely, the threat of four Democratic circuit judges being confirmed.
    2. This moment is a case study for why it’s important that we get people like Mandela Barnes over the line in Wisconsin against Ron Johnson in 2022, when he lost by just 1%. With him, Democrats would have had a 52-48 majority, nullifying Manchin and Sinema.
    3. But then again, it’s moments like these that bring up a question I have from time to time: do Democrats actually want to win? Do they even care? This isn’t a “there isn’t a big enough Democratic majority” problem. This is a “We’re the Democrats, and we’re okay with giving up 4 circuit judges to Trump for a few days of vacation” problem.
    4. And speaking of which, if it wasn’t already obvious, Democrats never really meant it when they called Trump a “fascist” or “threat to democracy”. It was just an empty campaign slogan. The reason many people didn’t buy Dems attacks on Trump as a “threat to democracy” is because they sniffed out that Dems are phony. You say Trump’s a threat to democracy, and then you give him four circuit judges. What does that make you?

    The more I think about it I didn’t care for Tillis bold face childish temper tantrums and telling others what to do and I would like to see Schumer and Dems take that circuit seat on the 4th confirm Park …..I am not the type however disgusted I am to roll over and withdraw .. We Are the majority for 3 more weeks We have to push thru like we are…. Thanks to all who are putting Schumer and Durbin on notice this isnt acceptable…. It can not be acceptable to have weak skinned impatient leaders who need their sleep 24/7… ps I’m also watching to see how 91 yr old Grassley does as judiciary chairman.     I am finding it hard to sleep, i close my eyes and wake up with the thought of james ho and lawrence van dyke lite in their 30s or 40s on this circuit court seats , especially the 1st circuit we thought was trump proof and it sickens me to my stomach, i sincerely with all my heart hope the worst for sen manchin and sinema family, children and all loved ones. I dont advocate any form of violence against them but if i would not share a tear if them or their wife/spouse or kids suffer an untimely demise, all i hope is it be painful as it can be.

    its that serious to me, its that vile what this democrats have done. Its that evil of a betrayal. I cant let this go. This is a travesty, but the troll frank who belongs in on stormfront and not here talking judges will assure us it will all be okay and the other users will indulge and agree with his nonsense.

    I curse the day schumer became majority leader.

    I could see Patrick Strawbridge or Judge Lance Walker for the First Circuit. I don’t know anyone else who could fill the seat because I don’t know much about Maine’s conservative legal circle.

    Whats confusing is that all Chuck had to do was keep the senate in session for one extra day, today, and completely justify it by pointing to republican obstruction.

    if he was worried about not having the votes he could have threatened Sinema with completely pulling her friends nomination and letting Gallego Arizonas next district judge.

    that probably brings her in line and he could tell Manchin to go home and miss the votes if he wouldn’t vote on the clotures.

    that’s it, 50-49 worst case. How do you fail so spectacularly?

    I desperately want to believe it’s more complicated than that but the last 4 years has known me no it’s not, the democrats are just lazy cowards who are afraid to use their power unilaterally.

      That’s exactly the answer sadly. Working today & tomorrow & then starting there vacation Sunday at least gets Lipez & Campbell confirmed. Then scheduling Mangi & Park over the next three weeks in session at least gives them a punchers chance of confirmation with an early retirement for Manchin and/or Sinema, a GOP senator or two absent, combined with VP Harris back from Hawaii.

      There’s no need to over complicate it. This Democrat senate leadership is lazy & caved so they didn’t have to work four or five extra days over the last five weeks in session. It’s inexcusable. They deserve the minority they are about to enter so that a majority Party can show them what to do when you have power. Hell you can argue a governor from Florida is better at whipping his Party’s senators into shape than the majority leader of the senate for the other Party. It’s a sad state of affairs but it’s the reality we have unfortunately.

    Schumer should have said no f-ing way am I not getting any circuit court confirmations. He should have threatened to keep senate in session nonstop til Jan 3 when GOP takes over..

    It’s so hard to grasp handing 4 appeals court seats to someone as vile as Trump. Handing 4 seats over to a normal Republican president like a Ford or Bush would be bad enough, but so much worse when its the Fuhrer Trump

    This whole saga really is distressing. I badly wish they had taken the time in September to work through at least Campbell and Lipez (and Kidd I guess) so that the only thing they had to “negotiate” was the Mangi nomination and the Park one (which was not even through SJC yet). Two vacancies, one of which could be rescinded, would feel like much less of a loss.

    We can only hope for a reversal of some sort, but I don’t see it happening with the way Schumer worded his statement. Very sad end to what was, otherwise, a very good four year run for judges.

    As with Patrick Leahy and his stupidity with blue slips, with this move Schumer and Durbin have shown they need to head out to pasture as well with this move to gift Republicans Circuit court seats that could and should be filled under Biden.
    District court judges who can be easily overruled by Circuit court ones (not to mention SCOTUS) don’t matter as much in the grand scheme of things and Schumer/Durbin trying to spin it otherwise is BS and we all know it.
    Also, screw Sinema and Manchin, their antics are why we’re in this position as well.
    May the door hit both of them on the way out.
